LIQUOR CONTROL BOARD
February 19, 2020 1:30 P.M.

Present: Commissioner Piepkorn, Commissioner Gehrig, Police Chief Todd, City Auditor Sprague, Chris Ohman, Environmental Health
Absent: Grant Larson
Others Present: Rick Carik, Rick’s; Duane Litton, Duffy’s; Dave Erickson, Bulldog Tap, Nikki Berglund Bernie’s; Dean Bachmeier, Buffalo Wild Wings, Dustin Mitzel, Happy Harry’s, Doug Restemeyer, DS Beverages and Doug Murch, Comney Law as well as representatives from Target Corporation and other interested parties.

Meeting was called to order at 1:30 P.M.

1. Commissioner Piepkorn called the meeting to order and asked if there were any additions or corrections to the minutes of January 15, 2020. There were no additions or corrections to the minutes of January 15, 2020. Moved by Gehrig, seconded by Todd to approve the minutes of the January 15, 2020 meeting of the Liquor Control Board all voted in favor, motion passed unanimously.

2. A. The first application to consider today is the issuance of a Class “CW” alcoholic beverage license to 3 Kings Lounge, LLC d/b/a 3 Kings Lounge located at 11 18th Street South.

Sprague explained the applicant called to inform the City they were not able to secure the location; it has been rented to another group. At this time, it is best to withdraw the application and submit a new application for the correct license classification once a location is determined.

Moved by Sprague, seconded by Todd to approve the withdrawal of the 3 Kings Lounge application. Motion approved unanimously.

B. The second application is for the issuance of a Class B-Limited alcoholic beverage license to STL of North Dakota Inc. d/b/a Target Wine & Spirits to be located at 4202 13th Avenue South.

Sprague explained the applicant has meet all the existing requirements and are not requesting any changes to the ordinances. Piepkorn asked if there were any comments from the Board or the audience, there were none.

Moved by Gehrig, seconded by Ohman to approve the issuance of a Class B-Limited alcoholic beverage license to STL of North Dakota Inc. d/b/a Target Wine & Spirits to be located at 4202 13th Avenue South. Motion approved unanimously.

3. Sprague said the Auditor’s office received a preliminary audit finding, there appears to be at least one business that failed the 50% food test. There is at least one other business that further information is needed before a final determination can be made. The information has been requested. Moved by Gehrig to continue the audit findings until everything is completed, seconded by Todd. Motion carried.

There being no further business to come before the Liquor Control Board, the meeting was adjourned at 1:37 p.m. The next regular meeting will be held Wednesday, April 15, 2020 at 1:30 p.m. in the City Commission Room.
