Meeting was called to order at 1:30 P.M.

I. Commissioner Piepkorn called the meeting to order and asked if there were any additions or corrections to the minutes of March 24, 2021. There were no additions or corrections to the minutes of March 24, 2021. Moved by Schwarzwalter, seconded by Nelson to approve the minutes of the March 24, 2021 meeting of the Liquor Control Board all voted in favor, motion passed unanimously.

2. A. Application for a Class FA-Entertainment alcoholic beverage license from Fargo TS LLC d/b/a Suite Shots to be located at 3400 James Way. This business enterprise will be an entertainment complex featuring golf. No issues or concerns were raised in the background checks.

Moved by Stibbe, seconded by Nelson to approve the application for a Class FA­ Entertainment alcoholic beverage license for Fargo TS LLC d/b/a Suite Shots. Motion carried.

B. Application for a Class FA-Entertainment alcoholic beverage license from TC Entertainment LLC d/b/a KingPinz to be located at 3485 Jacks Way. This business enterprise will be an entertainment complex featuring bowling. No issues or concerns were raised in the background checks. Questions were raised about minor present where alcohol is served, Sprague will prepare a memo detailing what is allowed.

Moved by Schwarzwalter, seconded by Nelson to approve the application for a Class FA-Entertainment alcoholic beverage license for Fargo TC Entertainment LLC d/b/a KingPinz. Motion carried.

C. Application to transfer a class "Z" alcoholic beverage license from Big D's Bar & Gri ll e d/b/a Shotgun S all y' s Rock N Roll to BB&E Partners-Fargo LLC d/ b/a Twin Peaks Resta u rant located at 1515 42nd Street South. This is considere d a goi ng concern as the nature of business and the location are not changing.

Moved by Stibbe, seconded by Tackett to approve the transfer of a class "Z" alcoholic beverage license from Big D's Bar & Grille d/b/a Shotgun Sally's Rock N Roll to

BB&E Partners-Fargo LLC d/b/a Twin Peaks Restaurant located at 1515 42nd Street South. Motion Carried.

D. Application to transfer a class "Z" alcoholic beverage license from Downtown Holdings LLC d/b/a Fort Knox to Vault Partners LLC d/b/a Fort Knox to be located at 52 Broadway N. The Health Department license is still pending.

Moved by Schwarzwalter, seconded by Stibbe to approve the transfer of a class "Z" alcoholic beverage license from Downtown Holdings LLC d/b/a Fort Knox to Vault Partners LLC d/b/a Fort Knox to be located at 52 Broadway, pending approval of the Health Department license. Motion carried.

E. Application for a transfer of a class "RZ-V' alcoholic beverage license from 670 Events Center LLC d/b/a Sancutuary Events Center to be located at 670 4th Ave North, Transfer due to a 5% or more ownership change.

Moved by Stibbe, seconded by Schwarzwalter to approve the transfer of a class "RZ-V' alcoholic beverage license from 670 Events Center LLC d/b/a Sancutuary Events Center to be located at 670 4th Ave North, 5% ownership change. Motion carried .

F. Application for a transfer of a class "F' alcoholic beverage license from DTSG Inc. d/b/a Famous Dave's to be located at 2581 45th Street South, transfer due to a 5% or more ownership change.

Moved by Nelson, seconded by Stibbe to approve the transfer of a class "F' alcohol c beverage license from DTSG Inc. d/b/a Famous Dave's to be located at 2581 45'1 Street
South, transfer due to a 5% or more ownership change. Motion carried.

G. Application for issuance of a class "GH" alcoholic beverage license from K & K Management LLC d/b/a Fry'n Pan to be located at 310 Main. Tackett questioned the ownership, Sprague later confirmed the individual in question is the manager not an owner.

Moved by Tackett, seconded by Schwarzwalter to approve the issuance of a class "GH' alcoholic beverage license to K & K Management LLC d/b/a Fry'n Pan to be located at 31O Main provided ownership can be clarified. Motion carried.

H. Application for a class "GH" alcoholic beverage license for Soiree's Sweets d/b/a Soiree Victorian Tea Room to be located at 3 8th Street South. Sprague was requested to follow up with the applicant regarding the debt and slow payment.

Moved by Stibbe, seconded by Schwarzwalter to approve the issuance of a class "GH' alcoholic beverage license to Soiree's Sweets d/b/a Soiree Victorian Tea Room to be located at 3 8th Street South. Motion carried.

I. Application for a class "GH'' alcoholic beverage license for Jay's Smokin' BBQ LLC d/b/a Jay's Smokin' BBQ to be located at 1322 Main Ave.

Moved by Schwarzwalter seconded by Nelson to approve the issuance of a class "GH' alcoholic beverage license to Jay's Smokin' BBQ LLC d/b/a Jay's Smokin' BBQ to be located at 1322 Main Ave. Motion carried.

3. Ellen Wall, Crown By Ellen Events, was not present to speak about her request for an event center license.

Moved by Schwarzwalter, seconded by Nelson to continue the agenda item until a future meeting. Motion carried.

4. Sprague reviewed the liquor license renewal status; Avalon and Chipotle did not attend the annual meeting, Juice It has not submitted their food sales report, Passage to India is missing the roster, no information has been received from Fargo Country Club, Wild Terra, Nail Deluxe and Wurst Bier Hall. Server training is in excess of 90%. Brewtus Club House failed the food percentage.

Moved by Schwarzwalter, seconded by Tackett to follow the penalty matrix and invoice the appropriate businesses, motion carried.

5. Chief Zibolski discussed a compliance check failure at Brew Bird. The recommendation was to follow the penalty matrix. There was discussion regarding the penalties, the failure can be waived if the server has attended server training. Chief Zibolski recommends establishments purchase an ID scanner.

Moved by Tackett, seconded by Schwarzwalter to follow the penalty matrix. Motion carried.

There being no further business to come before the Liquor Control Board, the meeting was adjourned at 2:18 p.m.
