• Motion to approve the minutes from October 15, 2025 meeting: Brekke
• Second: Doyle
• Clarification was made regarding THC content in drinks: confirmed as 0.3%, not 3%.
• Recommendation to refer the legality of THC beverages back to the City Attorney’s office for further review. Add to Other Items as 4c on the Agenda.
• Vote: Approved Unanimously.
2. Liquor License Applications
2A. Spaghetti Western doing business as Spaghetti Western
Location: 524 Broadway
• Request to upgrade from GH (beer/wine with food) to Class F (beer, wine, spirits).
• No bar; 80% food sales.
• No issues with background check.
• Motion to approve: Hackman
• Second: Brekke
• Vote: Approved Unanimously
2B. HIWA Lounge LLC doing business as Holiday Inn
Location 3803 13 Avenue South
• Ownership Transfer from 383 Spirits LLC to HIWA Lounge LLC.
• License class (ABH) remains unchanged.
• No issues with background check.

3. Police Department Report
A. Monthly Report
• Two after-hours violations reported at a newly licensed venue.
• Discussion on new state statute 05-02-10 limiting the timeframe for reporting and addressing violations.
• Motion to direct the City Commission to direct the City Attorney to request clarification from the Attorney General on ordinance preemption and enforcement timelines: Brekke
• Second: Hackman
• Vote: Approved Unanimously

B. Review of Application Guidelines
• Motion to direct the City Attorney, Police Department and Deputy City Auditor to review and update background check and licensing guidelines: Hackman
• Second: Brekke
• Vote: Passed Unanimously
• Topics discussed:
o Out-of-state applicants and lack of background check mechanisms.
o Proposal to require FBI fingerprinting for applicants.
o Clarification on how recent violations affect renewals.

4. Other Items
A. Wine Accessory License – Draft Ordinance
• First draft presented for discussion.
• Concerns raised about:
o Quantity limits (e.g., 2 bottles per person = 8 per table).
o Potential overlap with retail wine sales.
• No vote taken; item to return for public comment and further review.

B. Nonprofit Liquor Licensing
• Concerns raised about a nonprofit establishment misrepresenting its business model.
• Motion passed to have the City Attorney review legal options and licensing implications.

C. ID Scanners
• All scanners currently loaned out.
• Request made to explore acquiring more units or budgeting for additional scanners.
THC Beverages
• Ongoing discussion on legality, regulation, and public safety concerns.
• Noted that federal guidelines have changed THC limits from 0.3% to 0.4 mg total.
• Motion to continue monitoring and include updates in future agendas.
